Privacy Statement


1. Personal Information

Personal information is data that can be used to uniquely identify or contact an individual. When you (“User”) use My Health Direct, Inc.’s website, participate in an online survey or submit information to MHD through MHD’s online forms, MHD may collect a variety of information, including User’s name, electronic mail address, telephone number and mailing address. MHD may share this personal information with MHD’s representatives, contractors, employees, agents or advisors and otherwise use such personal information consistent with this Privacy Policy (this “Policy”).

2. Non-Personal Information

Non-personal information is data in a form that does not permit direct association with any specific individual. MHD may collect non-personal information such as User’s zip code, area code, unique device identifier, location, the time zone where MHD’s website is accessed and other information regarding User’s activities on MHD’s website. MHD may share with MHD’s representatives, contractors, employees, agents or advisors aggregate statistical information regarding, among other things, User’s website usage and User’s non-personal information. If MHD combines non-personal information with personal information, the combined information will be treated as personal information for as long as the information remains combined.

3. Use of Personal Information

The personal information that MHD collects from User allows MHD to develop, deliver and improve MHD’s products, services, content, advertising and customer communications and provide User with updates on MHD’s latest products and services. From time to time, MHD may also use User’s personal information to send important notices which include, but are not limited to, changes to this Policy. MHD may also use personal information for internal purposes such as auditing, data analysis and research to improve MHD’s products, services, content, advertising and customer communications. Unless otherwise authorized by User, MHD will not knowingly give, sell, rent, or loan any of User’s personal information to any third party. MHD will retain User’s personal information for the period necessary to fulfill the purposes outlined herein and in any agreement between MHD and User unless a longer retention period is required by applicable law or regulation. Notwithstanding any thing to the contrary in this Policy, MHD may disclose personal information as required by law or when such disclosure is necessary in order to protect the rights of MHD and/or comply with a judicial proceeding, court order or other similar lawful process. MHD may also disclose information about User if MHD determines that such disclosure is necessary to protect MHD’s operations or other users or to enforce this Policy. In the event of a sale of all or substantially all of the assets of MHD, MHD may transfer or assign any and all personal information MHD collects regarding User to the relevant third party without notice to, or the consent of, User.

4. Communications

MHD may, from time to time, communicate with User by electronic mail, online newsletters (in the form of electronic mail), pop-up windows and confirmation letters. MHD may notify User of any new or deleted features of MHD’s website. MHD does not guarantee the confidentiality of any communication or material transmitted to or from MHD’s website, transmitted by the internet or other global computer networks or transmitted by electronic mail or facsimile transmission between User and MHD. Any electronic mail or facsimile transmission between User and MHD may be shared with a representative, contractor, employee, agent or advisor of MHD that is most able to address the inquiry.

5. Surveys

MHD may conduct voluntary surveys from time to time for the purpose of improving MHD’s products, services, content, advertising or customer communications, which MHD may share with third parties to illustrate, among other things, samplings of users and general user preferences, but participation in any such survey is voluntary, the results of such surveys will be displayed as aggregate results and Users’ individual identity will not be released to any third party without Users’ prior consent.

6. IP Tracking (Log Files); Cookies

In order to improve and personalize MHD’s website to User’s needs, MHD may track IP addresses and use information stored on User’s hard drive (“Cookies”) to track, among other things, User’s content preferences and traffic patterns, the number of times User has utilized MHD’s website in a given period of time and the pages User has visited. User may disable Cookies at any time by adjusting User’s web browser settings.

7. Protection of Personal Information

MHD takes commercially reasonable precautions to protect User’s personal information against loss, theft, misuse, unauthorized access, disclosure, alteration and destruction. MHD stores all of the confidential information it obtains about User behind redundant firewall systems and evaluates from time to time the quality of its technology used to protect User’s personal information. Certain information submitted to MHD by User is encrypted using Secure Sockets Layer technology.

8. Changes to Policy and Use

If MHD modifies or changes this Policy, MHD will post a notice on MHD’s website along with the updated policy or notify User by electronic mail. Changes will be effective and binding as of the earlier of (a) posting of the notice to MHD’s website and (b) the date of the electronic mail, as the case may be, unless a different effective date is specified; provided, however, that if MHD desires to use personal information in a manner different from the policy in effect at the time MHD obtained such personal information from User, MHD will seek User’s consent in order to use User’s personal information in the desired manner. If MHD does not obtain User’s consent, MHD will use User’s personal information in accordance with the policy in effect at the time such personal information was obtained by MHD.

9. Termination

MHD may, in its sole discretion, terminate User’s access to MHD’s website at any time and for any reason.

10. Law; Venue

This Policy and all questions in connection herewith shall be governed in accordance with the laws of the State of Wisconsin without regard to its principles of conflict of laws. All disputes arising hereunder shall be resolved exclusively in state or federal courts located in Milwaukee or Waukesha County, Wisconsin, to which jurisdiction and venue the parties hereto irrevocably consent.

11. Severability

The invalidity or unenforceability of any provision hereof shall in no way affect the validity or enforceability of any other provision. If any provision of this Policy is found invalid, illegal or unenforceable pursuant to judicial decree or decision, the remainder of this Policy will remain valid, legal and enforceable according to its terms.

12. Additional Information

Any information available through MHD’s website that is not identified as having been prepared by MHD (including, without limitation, any information accessed through a third party website referenced or linked from MHD’s website), is not endorsed by MHD and is provided for the convenience of User only and MHD has not evaluated and does not guarantee the accuracy or completeness of any such information. User acknowledges and agrees that third parties may obtain unauthorized access to MHD’s website and gain access to information provided to MHD by User; however, MHD shall incur no liability whatsoever in connection with any such access by unauthorized third parties. MHD does not knowingly collect personal information from children under the age of thirteen (13), but if MHD learns that it has collected the personal information of a child under the age of thirteen (13) (without parental consent), MHD will take steps to delete such information as soon as possible. User acknowledges that the information contained in MHD’s website is general in nature and is not a substitute for professional health care. If User has specified health care needs, User should consult an appropriate health care professional. By using MHD’s website, User consents to the collection and use of the information obtained by MHD pursuant to this Policy and acknowledges and agrees to the terms and conditions contained herein.
